Michigan Department of State to issue driver’s licenses to qualified deferred action program participants after federal government reversal
LANSING, Mich. – The Michigan Department of State – in light of a recent reversal by federal officials on whether Deferred Action for Childhood Arrivals participants are lawfully present – is now required to issue those participants driver’s license and identification cards, the department announced today.
“Michigan will only issue driver’s licenses to individuals who are here legally,” Michigan Secretary of State Ruth Johnson said. “The feds now say they consider these young people to be lawfully present while they participate in the DACA program, so we are required to issue driver’s licenses and identification cards. I will continue to follow the law.”

On January 3, 2013, U.S. Citizenship and Immigration Services (USCIS) published a final rule in
the Federal Register, “Provisional Unlawful Presence Waivers of Inadmissibility for Certain
Immediate Relatives,” with an effective date of March 4, 2013.1 This rule allows certain
immediate relatives of U.S. citizens (spouses, parents of adult U.S. citizens, and minor children)2
who are physically present in the United States to request a provisional waiver of the unlawful
presence bars to admissibility under INA §212(a)(9)(B)(i) prior to traveling abroad for consular
processing of their immigrant visa applications.
How Is The Rule Beneficial?
Under current law, a significant number of immediate relatives of U.S. citizens who are present
in the United States are not eligible to apply for lawful permanent resident (LPR) status in the
U.S. because they entered the country unlawfully. Instead, such aliens must depart the U.S. and

Will EB-5 10,000 visa cap be reached this year?

in 2012, China accounted for over 60% of all EB-5 visas worldwide, and was the main reason that the EB-5 10,000 visa cap was reached for the first year ever. The rumor for 2013 is that EB-5 numbers for China will cease to be current in the visa bulletin in Q3 (i.e. April, May, June), thus ensuring that the China percentage of EB-5 usage perhaps drops under 60%. If this indeed turns out to be the case, then China may be on its way down to perhaps 40% of the worldwide EB-5 - still #1, but no longer as dominant as it had once been. The rising countries will very likely be S. Korea and Iran, with the biggest growth coming from countries such as Brazil, Russia, and India.
